Spanish Tax Lease System
Basically the Spanish Tax Lease is implemented through the creation of an Economic Interest Group (EIG), which -under the structure- leases the vessel to the Buyer through a bareboat charter. The EIG is allowed to accelerate depreciation of the vessel for tax purposes before the vessel enters into operation, which creates corporate income tax losses for the investors in the EIG. Those investors (major tax payers) thereby obtain a temporary tax benefit (the initial decrease in their corporate income tax bases) through the accelerated depreciation system. Because the investors obtain a tax advantage, they are willing to accept a lower financial return, which brings down the cost of the vessel for the Buyer.
The scheme – which has been approved by the EU authorities – makes it possible to deduct for tax purposes the cost of certain assets acquired through leasing as soon as their production begins, without having to wait for them to enter into commercial use. It therefore adds to the possibility already available to Spanish taxpayers of accelerating the deduction of such costs by reference to the payments made under a leasing contract. The scheme applies to all types of tangible capital assets acquired through
leasing, provided they are manufactured according to the purchaser’s technical
specifications and that it takes at least
a year to produce them.
